Welcome to Bagzy. These Terms of Service govern your access to and use of our website and services. By visiting our site and/or purchasing something from us, you agree to the following terms and conditions (“Terms”, “Terms of Service”).

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country or region. You may not use our products for any illegal or unauthorized purpose.

You must not transmit any malware, worms, or viruses. A breach or violation of any of the Terms will result in immediate termination of your access to our Services.

We reserve the right to refuse service to anyone for any reason at any time.

Your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service without notice.

Certain products or services may be available exclusively online. These products or services may have limited quantities and are subject to return or exchange only according to our Refund Policy.

We make every effort to display our products as accurately as possible. We cannot guarantee that your device’s display of any color will be accurate.

We reserve the right to limit sales of our products to any person, geographic region or jurisdiction. We may discontinue any product at any time.

Please note that actual colors may vary slightly due to lighting or screen display differences. We do our best to ensure that our product photos represent each color as accurately as possible.

All delivery times provided are estimates and not guarantees. We are not liable for delays outside our control, including customs, weather, courier issues or other external factors. Once an item is shipped, the risk passes to you. 

Ownership of the products transfers to you upon shipment. If your package is lost or delayed, please contact the carrier first and then reach out to us for assistance.

We may provide access to third-party tools we do not monitor or control.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties. Your use is entirely at your own risk and discretion.

Our store is powered by Shopify Inc. They provide the e-commerce platform that allows us to sell our products to you. However, all contracts are entered into with Bagzy. Shopify is not responsible for any aspect of sales between you and Bagzy. Or for our order handling, returns, or customer support. 

 

 

SECTION 10 – PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy. By using our service, you consent to data processing that may include data transfers outside the EU.

 

 

SECTION 11 – USER COMMENTS, FEEDBACK AND SUBMISSIONS

If you send us suggestions, ideas, or other content (collectively, “Comments”), you agree that we may use them without restriction.

We may monitor or remove content that we determine to be unlawful, offensive, or in violation of these Terms. You are responsible for any comments you make and their accuracy.

We reserve the right to terminate your use of the Service for violating any of these prohibited uses.

 

 

SECTION 14 – RIGHT OF WITHDRAWAL (EU CUSTOMERS)

If you are an resident of the European Union, you have the legal right to withdraw from your purchase within 14 days of receiving the item, without giving any reason.

To exercise this right, email us at bagzy.contact@gmail.com. After notifying us, you must return the product within another 14 days. Upon receiving the item (or proof of shipment), we will refund your payment, including original delivery costs, within 14 days.

Return shipping costs are your responsibility.

Exception: This right does not apply to personalized or custom-made products (e.g. customized accessories), unless they are faulty or incorrectly delivered.

 

 

SECTION 15 – TERMINATION

We may terminate this agreement at any time without notice if you breach any part of these Terms. Upon termination, your right to use the Service ends immediately.

 

 

SECTION 16 – DISCLAIMER OF WARRANTIES

We do not guarantee that your use of our service will be uninterrupted or error-free. The service and all products delivered to you are provided “as is” and “as available,” without any warranties.

Some jurisdictions do not allow the exclusion of certain warranties, so these exclusions may not apply to you.

You agree to indemnify, defend and hold harmless Bagzy, Shopify, and our affiliates from any claim or demand arising out of your breach of these Terms or your violation of any law or third-party rights.

If any provision of these Terms is found unlawful, the unenforceable part shall be deemed severed, and the remaining provisions will remain in effect.

These Terms are effective unless and until terminated by us or by you. They constitute the entire agreement between you and us, governing your use of the Service.
